We can all rest easier now.

The lawsuit that Anna Nicole Smith companion Howard Stern filed in U.S. District Court in West Palm Beach against famed Texas lawyer John O’Quinn has been settled.

In several TV interviews in the aftermath of Smith’s death, O’Quinn intimated that Stern murdered the Marilyn Monroe wannabe.

“Honestly, I can’t say one word about the lawsuit,” Stern told Page2Live, trying to explain why, for once, he has nothing to say. “There’s a confidentiality agreement and I can’t confirm anything.”

Court records, however, are doing some of the talking. They show reps for Stern and O’Quinn went before a mediator in Coral Gables Oct. 30 and worked it out. No details about the settlement are available.

Stern filed the slander action against the Houston barrister in April 2007, two and a half months after model and reality TV star Smith was found dead in her room at the Seminole Hard Rock in Hollywood.

O’Quinn represented Smith’s mother, Virgie Arthur, in the post-death court battle for the custody of Smith’s infant daughter, Dannielynn. Both Stern and former paparazzo Larry Birkhead claimed to be the baby daddy. DNA showed it was Birkhead.

O’Quinn accused Stern of murdering Smith on Fox News and MSNBC, telling the latter that Stern has ulterior motive for demanding to see Smith’s will days before she died.

Autopsies showed Smith died from “combined drugs intoxication.” Authorities said there was no sign of foul play.

O’Quinn, meanwhile, defended himself against Stern’s lawsuit by claiming there was no malice in his statements, and that he expressed his opinion “in the context of tabloid media.”

He didn’t return calls for comment.

There’s a mistake up there…. Dannielynn is I believe a girl and not a boy, thereby making her the infant daughter and not son of Smith.

If Howard is happy with the settlement,I am happy for him also.LOSE LIPS SINK SHIPS,something a Officer of the court should already know.Maybe next time OQ will think twice before slandering anyone.

I don’t understand why you said, “for once, he has nothing to say”. Howard was not the one with the big mouth in the first place, O’Quinn was.
    And O’Quinn’s excuse is pitiful.

What is wrong with you? I showed you proof that your article is wrong by saying Anna died from Methadone and now my post is gone! Anna did not die from Methadone! Anna died from Chloral Hydrate. Daniel Wayne Smith, Anna’s son died from Methadone.

Howard, i’m happy for you.Justice prevailed.I hope you will find a good woman who will love and respect you. You deserved to be happy, after so many years of pain and misery caused by Virgie Arthur and Anna Nicole.

I hope this is a lesson for attys to stop using the media to sway public opinion, gain advantage in a courtroom and think they are higher then the law. No man should have been kicked so visciously after losing two close friends. God bless HKS for protecting his name and fighting for those he loves!

    Glad that Virgie lost…she deserves nothing {& should be fined by the courts for wasting their time!}

I am still concerned about the enabling by HK$…if he had “controlled” the access to the “duffle bag” which he took “care of” then ANS probably would have been alive today!

I realize that ANS got rid of everyone who cared about her except “pond-life” who assisted her with drugs, and I include HK$ in this category!

IMO he must be charged with ENABLING!

John O’Quinn should make a public apology to Howard and his family.Howard stay strong!!

Howard didn’t get a red cent out of the settlement. Stern settled instead of using a court of law to deny O’Quinn’s accusations. Technically, Stern is still an accused murderer.

In The Know, I am very curious how you would be privy to this information. To make such a comment and if you are indeed “in the know” to report it on the internet, not to bright.

To In The Know….if you are truly in the know, you have broken the confidentiality agreement and could be prosecuted?

One law suit down, how many to go? this group of people is completely rediculous- law suits are not the answer to every single problem they encounter.
Of course, they will never learn this lesson if people keep settling with them…although, i guess it’s the lesser of two evils when you know their history and the extent to which they fight things out. How long have they been litigating J. Howard’s will?

13-At least it looks like no one remotely involved with Smith’s estate will ever see a cent of the Marshall fortune. The 9th will almost surely defer to the original TX court’s decision…
