A respected Palm Beach Sheriff’s Office captain is under Internal Affairs investigation today for firing a gun in his cramped office, in the presence of two other people.

No one was hurt, but PBSO spokeswoman Teri Barbera tells me Capt. Matt Eisenberg, 49, a 25-year veteran of the agency and the commander of a district west of Boca Raton, is the target of the incident review.

“We still don’t know exactly what happened, but it appears there was an accidental discharge,” Barbera said. “I.A. will have to determine if procedures were properly followed.”

A PBSO source tells Page2Live that the captain was at his desk at District 7 on 441 with two Glock handguns. One was loaded and the other empty.

I’m told the captain mentally lost track of the loaded firearm when he received a phone call. After he hung up, Eisenberg supposedly picked up one weapon and placed it between his legs to dry fire it towards the floor.

A round went off — startling the commander and two others, a deputy and a civilian crime analyst.

Eisenberg remains at his post pending the I.A. report.

So how does this thing “accidentally” fire?

    “Information Online Below:”

“……In 2003, Glock announced the Internal Locking System (ILS). The ILS is a manually activated lock that is located in the back of the pistol’s grip. It is cylindrical in design and, according to Glock, each key is unique. Group key hierarchic solutions are available for law enforcement agencies. When activated, the lock causes a tab to protrude from the rear of the grip. This is done to give both a visual and tactile indication as to whether the lock is engaged or not. When activated, the ILS renders the Glock unfireable as well as making it impossible to disassemble. When disengaged, the ILS adds no further safety mechanisms to the Glock pistol.

  12. Comment by procedure — November 18, 2009 @ 8:32 am

Was this dry fire procedure followed?

Dry Fire is only supposed to be used to make sure a weapon is NOT LOADED and with the Chamber empty and clip removed.

Here are some rules from online…..

……. repeated dry firing hurts your weapons. It slams the bolt on an empty, chamber without the cushion of a cartridge case to help absorb the impact. So repeated dry firing will lead to increased wear and damage to the bolt and chamber. If the damage or wear isn’t caught during PMCS PMCS

All that dry firing isn’t necessary to make sure a weapon isn’t loaded. Every weapon’s -10 TM gives the procedure for clearing a weapon and making sure it’s safe. Commanders can save wear and tear on weapons by having soldiers do the -10 procedure instead of dry firing.

    1. Point the weapon in a safe direction and place the selector(programming) selector - 1. In Smalltalk or Objective C, the syntax of a message which selects a particular method in the target object.

    2. An operation that returns the state of an object but does not alter that state.
….. Click the link for more information. lever on SAFE.

    2. Press the magazine catch button and remove the magazine.

    3. Pull the charging handle back to lock the bolt open.

    4. Press the bottom of the bolt catch and let the bolt move forward until it engages the bolt catch. Let the charging handle slide back into place. Make sure the selector is still on SAFE.

    5. Check the receiver and chamber to make sure they contain no amino.

    6. With the selector still on SAFE, let the bolt go forward by pressing the upper portion of the bolt catch.

You can do this check in three minutes

    PBSO “DRY FIRE” procedure”

    1. Take 2 GLOCK pistols. Not Identical. One Loaded, clip in. One Unloaded, clip out.

    2. Place on your desk, barrels facing towards the Deputy and Civilian sitting in office with you. This way if either weapon discharges accidentally, you will not get shot.

    3. Take phone call with witnesses in your office. Talk and forget about the guns.

    4. Finish call. Decide to check which Glock is unloaded or loaded.

    5. Do not manually check for shell in chamber or remove clips of either weapon.

    6. Make sure you are in an occupied building, make sure at least 2 witnesses are in your office watching you.

    7. Pick up the GLOCK with the ammo clip inserted, safety off and live round in the chamber.

    8. With witnesses watching you, in an occupied building, place loaded weapon between your legs, just in front of your p_nis.

    9. Depress the first trigger on a GLOCK which is the safety, then fully depress both triggers and fire live round into the floor.

    10. Crap your pants and promptly make up cockamammy story for the Internal Cover-Up Department.

    11. Make sure you are a ‘really nice guy’ and hold the rank of Captain or Higher….if you are sleeping with the Female in charge of IA investigations, hey, its PBSO, so much the better.

    12. Get a raise, a promotion, paid-leave while investigated….hang out with B. Kisher and Sheriff B-Shaw, drink beer, play poker and clean your Glocks together…and laugh at how stupid the public is for questioning any action of a PBSO Officer, who are of course, above the law, beyoned the reach of the law and do not answer to the same laws that they enforce against the little people, John Q. Public, who they work for and are paid by.

  15. Comment by Glock Firearms — November 18, 2009 @ 2:05 pm

    To: Procedure and all

FYI, to take a glock pistol apart, the trigger must be pulled to activate the disassembly. However, the glock will fire without the mag in the gun and a round in the chamber. That is why it is important to check the chamber and not just drop the mag out. Glock does allow this because in a close combat situation, the mag button might be pressed inadvertently and the mag drop, but the officer can still shoot the gun with the one round already in the chamber. Also, dry firing does not hurt the gun, actually, dry firing is recomended to train your trigger finger to apply the right pressure to the trigger and shoot successive rounds without taking your finger out of the trigger guard. Dry firing is a proven training method. Further, glocks do not have a manual safety.

Obviously, before you take apart the gun or dry fire, your attention must be 100% on what you are doing, you cannot be talking to someone, talking on a cell phone or even eating. Distraction can be deadly and the Captain was lucky by pointing the gun in a safe direction to the ground and pulling the trigger only to find out that it was in fact loaded with the one round in the chamber. I know that the Captain will check the chamber 100% of the time now.

This potential mistake happens all the time with the glock, check out the DEA agent on youtube who shoots himself in the thigh in a classroom.

Dry firing into the floor of an occupied building , in a cramped office with 2 other people watching?

Firing any weapon in an occupied building is against the law right?

C’mon guys….ya’ gotta come up with a better story than this.

  17. Comment by obie one — November 18, 2009 @ 3:49 pm

    It’s lax rule following.

  18. Comment by Glock Firearms — November 18, 2009 @ 4:37 pm

    Mo betta,

Dry firing in an occupied building is not dangerous. Everyday, police training academies and police training do the dry firing drill in a classroom or gym. However, every gun is checked and re-checked to make sure they are empty. Also, leo’s clean guns in buildings and classrooms all the time. The issue is not dry firing or cleaning a gun in a building or classroom, it is paying attention 100% to what you are doing, and obviously, the Captain did not do that.

As to a law violation, not realistic, if he pointed the gun at someone and thought the gun was empty and just was playing around and the person was shot or came close, yes, however, this is not the case here.

Mo betta, lets worry more about the thugs who killed the Lake Worth Clerk for no reason and the sex predators out there attacking children. Then if we clean all that up, we can debate the Captain not using proper gun safety.

  19. Comment by FL GUN LAW — November 18, 2009 @ 6:48 pm

    Here is the FL LAW:

“It is unlawful to knowingly discharge a firearm in any public place, or on the right of way of any paved public road, highway or street or over any road, highway, street or occupied building, except in defense of life or property, in performance of official duties or where expressly approved for hunting.”

Of course, unless, its a cop in Palm Beach County shooting in the occupied building. Then you get to make up a story and get off scott free…..like all the other cops let each other pass for….you get to say, you did not know, etc……watch the average person try that……….why was this guy even attempting to shoot in his office with 2 other people in the office with him? It does not smell right. It sounds like a lie. Cops go to the range for that stuff or should….they can go to gun ranges all over the county. Shooting in their office with others in the office?

    Its getting real old.

The people are sick of it.

  20. Comment by Abuse of Badge — November 18, 2009 @ 6:53 pm

PBSO booking blotter every day is 90% arresting people for very, very MINOR offenses and they fill the stockade up with minor offenders for the most part……pot possesion, loitering, missing a court date, driving with suspended license and the Sheriff’s cut them ZERO slack.

Why should they not be arrested and prosecuted to the letter of the law just because they are in a uniform….is the uniform a reason to let them break the law and get away with it?
