Big break: Mayor Lois Frankel stopped for speeding near school, gets no ticket!

Funny thing happened to West Palm Beach Mayor Lois Frankel on her way to City Hall this morning.

Herhoner was stopped by West Palm Beach Police for speeding through a downtown school zone near Dreyfoos School of The Arts.

Guess what?

No ticket!

I’m told by a source at the PD that Frankel, 61, was at the wheel of her old Acura at the tail end of morning school arrivals when she was clocked 26 mph over the speed limit — that’s 46 mph through a 20 mph-zone with kids and school buses! — by Officer Josh Martin.

Martin stopped her and let Herhoner know she was going fast, but let her go with no ticket.

According to the Florida Statutes, a fine for going 26 mph above the limit is $205.50. But in a school zone at morning rush hour, the fine is doubled to $411.

Martin declined comment, saying: “I don’t wanna do no interview!” His boss, Chief Delsa Bush, who was hand-picked for the job by Frankel, didn’t return calls.

Frankel stuttered briefly when I asked her about the incident, and her recipe to get out of a ticket. She hung up the phone.

But her public relations man, Chase Scott, just put out this statement:

” Wednesday morning, Mayor Frankel was informed by a West Palm Beach officer that she was exceeding the speed limit. The Mayor apologized to the officer stating she was not aware of the change in speed zones and said quote: ‘Please, treat me as you would any other driver in this circumstance.’ The officer advised her that he was not issuing a ticket. Officers use discretion in the course of their duties everyday and, in fact, the same officer made 5 stops in the past 24 hours and issued only 2 citations.”

    Lois Frankel doesn’t know about speed zone laws!!? Courts tell every citizen, “Ignorance of the law is no excuse,” and it should be even less of an excuse for elected officials. Knowing the law is her JOB, for God’s sake! Not to mention in this case, it’s just common sense to slow down around children and it’s immoral not to.

    Since when is it the “descretion” of an officer whether or not to issue a ticket on a State law that was violated? Really? Do they also have discretion when arresting, robbers, rapists, drug dealers and thieves? WTF? PD: JUST DO YOUR JOB- No matter sho violates the law.

    I’m a big fan of the police but I’ve not seen one patrol car slow down for that zone - why should the mayor? Why should any of us? And is it a real school zone w/out a flashing light? My sources say no. The question: was she 26 over the (alleged)school zone speed of 20, or the regular posted speed of 30?

    I am heading to the Mayors Office tomorrow to issue a Citizens arrest on the Mayor for Corruption.

    Then I am going top the the West Palm Beach police Department and asking for Josh Martin and serving a Citizens arrest for Obstruction of justice and corruption.

    There is nothing they can do to me.

    I am coming to arrest both of them and will have Cameras with me.

    Seriously????? Any of us would have been given a ticket in a (*&(&(& heartbeat! Ticket her now!!!!

    I live in N. Florida and was driving on 95 south and did not notice the speed changed during a construction area (did not look like a construction area nor did it have workers) and I was given a ticket. I asked the officer why i was being pulled over as was only doing 72 and he said the speed had reduced and pointed back about a 1/4 of a mile. No sympathy there. I got a ticket!!

    The crime is not Lois’ beating the speeding rap. It’s her lack of respect for the law. Any true police official will tell you that speeding in school zones is a major problem here in So Florida. Again, her “I’m better than you, I can do no wrong” attitude shines bright.

    I know exactly where the PD sits right there and everybody that works down there knows to slow down in that area. Our butts would have gotten a ticket. I’ve seen the PD do it all the time. Ticket the witch and make her pay a 400 dollar fine like everyone else. I bet she called the chief to get out of it.

    Are you kidding me!? What would have happened if she hit a child or a school bus? Would they have looked the other way then? The officer who let her go needs to switch careers, and Frankel should have gotten his name and badge for NOT issuing a ticket to someone who was so obviously disregarding the law.

    i ran the red light at forest hill and 441 one morning taking my daughter to the orthodontist.i was pulled over by by an officer about 1/2 a mile down the road.guess what all you haters?I DIDNT GET A TICKET.and im a guy.i just admitted it like a man should.end of story

    I’d love to know when the Post is going to come out and tell the public they’re basically owned by the Sun Sentinel.

    The press by downtown West Palm, owned by the Sentinel and rented by the post. 3 of the 4 floors of the old post building is opperated by the Sun Sentinel.

    this is a shame I too have been stopped in a school zone and I was not even speeding!!!! I did have to take time off from work (in a school)to resolve this matter…I guess some people are more “special” than others

    I did something remarkably stupid the other morning, got stopped by a WPB police officer, who had EVERY RIGHT to ticket me, and he issued a warning. I am a nobody. I drive an expensive car and was treated MORE THAN FAIRLY. Do not diss the officer for this. He does NOT have to issue a citation. And, I am not a fan of the mayor, either.

    I am just glad my child wasn’t walking in the area.

    The mayor should not be held to the same standards as normal citizens… she should be held to higher standards, and she should be setting an example for how she would like the citizens of her city to act.

    yea thats so BS… officers decide who they want to give tickets to and thats all fine ans well but i would like to see the pattern of certain officers… if the mayor was by my child’s school speeding while in session i would personaly go to her office and give her a piece of my mine… i dont care if she has to pay a fine because its not my money but if there was an accident then she would be looking silly by the face and god forbid….. good lick to everyone and happy diving in wpb with THESE officers

    First off, the fine would have actually been $456.00 for 26 over in a school zone. Secondly, there does not have to be flashing lights at a school zone, read your statutes once and a while. Everyone loves to comment, but no one knows the facts. Was anyone there? Did you see or hear what transpired? Officers have what is called “discretion”. They are allowed to give warnings or tickets, just the same. There is no law or policy that dictates otherwise. Have you ever heard of the media telling the truth about anything??? The mayor just froze the WPB Police Department’s pay plan and are looking to cut another 10% again by October of this year….so do you think that the officer would not have loved to issue her a $456.00 citation?? Of course, but what good is going to come of it? By the looks of the article and comments, it seems as the warning sufficed just fine! And for those of you that commented about the officer, I would love to see one of you tell him to his face. So on that note, keep hiding behind your computer and commenting on something that you have absolutely facts about. You make yourselves look much dumber than you actually are!

    Just shows the speed limits are too low, they need to increase the speeds on many roads as they are only low to produce income(can you say speed trap!)Even the esteemed mayor cannot drive that slow.     Im a cop and was issued a ticket by FHP and accepted it because I made a mistake. Whether I noticed the BS speed trap and just changed signs I still accepted it and paid the $300 fine. She nor anyone should get any different treatment. If that WPBPD officer did give her a ticket he would been on foot patrol directing traffic or worse fired if he were on probation. He did the right thing, because she is so vindictive and rotten. Thats why she wants to be disctator and stay there for ever in the 100 million dollar building with 200 flat screens so bad..

    Wow, so many mean spirited people on this site. I have been pulled over and not given a ticket. The officer is able to and should be able to make their own decision. Sounds like a bunch of sour grapes from people who did not get out of a ticket probably because they were mean spirited and rude to the officer like they are on this site. For anyone else throwing insults on this site, Mayor Frankel puts herself out there to serve the public and so does the officer. I thank them both for their good works in the community.

    Every driver who is reading this column should download it and keep a copy against the day that they, or any citizen, is ticketed for the same violation. Bring your copy to court, show it to the judge & tell the judge that you will go all the way to the State Supreme Court if need be. Judges don’t like to be overturned, and this copy will do it, so hang on to it.

    Also, if Ofc. Josh Martin is promoted in your LIFETIME, you have a good reason to remind the post of this article.

    You don’t think the cops (overpaid and a little spoiled) are ticked off about the way they are treated in the budget? Ask the cop who delivered the story to Jose. The mayor caught a break on a speeding ticket. We are all shocked. The mayor’s flack issued a dump ass statement. Someone call 911. Just be gald the cop was busy stopping speeders and not out harrassing his former girlfriends new boyfriends, stalking potential witness against the city in civil actions, or breaking into the homes of people who threaten to sue the depatment. Thank god for small favors, that’s all we should expect from this bunch.

    I wish my daughter, who is a new driver, had been given the same consideration when she drove through a school zone at 33 mph at 4:15 pm. (The end of the school zone time limit is 4:15 pm!!) Needless to say $406 was an exorbitant price when a stern warning would have been all she needed. The only saving grace is that she has seen how hard you have to work to make that much money. Money is tight for all of us. If you need the money then you should collect it from all of us and not just the common folks. Rules are rules.

    A posted school zone does NOT require electronic flashing amber lights to be considered a legal school zone. It just has to be properly posted in accordance with state law. That said, 46 mph is still 16 mph over the regular posted speed of 30 mp. Either way, the speed Mayor Frankel was traveling is in far excess of the posted speed limit for that area. And, every law enforcement officer has a right to his/her descretion in just about every matter involving their duties and responsibilities. The officer did his job. Mayor Frankel failed to do hers and should be embarassed that a public statement had to be made by someone other than herself.

    Finally to the poster that believes that we work on bonus points or incentives for writing tickets…I wish!!! Sadly the City only recieves approximately $42 for every $150 ticket written. And I can assure you this, if I did get an incentive for writing tickets I would write everyone I stopped.

    Yes, officers of the law have “discretion.” I was speeding and was stopped. I hardly ever speed, but I was passing and gave it a little more gas to move back over. I got caught. I told him to go ahead, give me a ticket, I was speeding. He took my license and insurance, went back to his car, took an awfully long time, then came back to my vehicle with his book in hand. “How long have you been driving?” I told him 42 years, without incident, without so much as a stop. “I’m not going to ruin your great record. Remember when passing, you don’t need to step on the gas more than necessary. If you don’t have room to pass effectively and easily, wait until you do.” Now I don’t pass at all!

    I just got a ticket for 41 in a 30 and it wasn’t even a school zone. I didn’t like getting the ticket but I was speeding and I paid the consequences. In her position as mayor she should have insisted the officer act accordingly ESPECIALLY IN A SCHOOL ZONE to show no prefered treatment!!!

    I also know driving in the morning downtown the motorcycle cops are parked in such areas for “1″ reason to hand out tickets to speeders! Officers discretion??… give me a break!!! And before I get accused of hating law enforcement like that meatball “Jose” from comment #4 half my family is in law enforcement and I have complete respect for them.

    Simple fact, Frankel got caught and was able to skirt the system with the help of one of her employees!

    I guess we all forgot that Martin is the same officer that took another officer’s job over a traffic citation.     As a police officer with West Palm Beach, I would have written the ticket. However, for those of you who have received tickets in the school zone on Tamarind Ave, by Dreyfoos, please take those citations to court. The school zone is not marked properly and is technically “unenforceable” because they have the “school zone” sign and then they have a regular speed limit sign right after it which technically ends the school zone. Take a picture of the signs and take it to court. I have been trying to get them to change the signs for years but no one wants to listen

    The subject “school zone” is actually a 30 mph “speed trap” along Tamarind that is a five lane roadway. There is no pedestrian traffic, students or otherwise, along this link because the railroad tracks are on the west side.

    I drive it every day and they should post it 45 or 50, which is about the average actual speed.

    Last year my husband and I came to spend our winter in sunny Florida. Went out to dinner at Mondo’s on US Highway 1 and while driving back to the condo, stopped for gas. A motorcycle police officer pulled in behind us and flashed his lights. We truly had no idea what we had done. Well, obviously, we were speeding and received a ticket in the neighborhood of $150! (The fact that my husband has a Purple Heart license plate got him no favor! If only he could be the Mayor!) I went to pay the ticket online and found I had to pay an additional $5 - $11 dollars, not sure of the exact amount, but with the already outrageous ticket price decided to pay in person. What a joke! The office was PACKED! It would have been at the very least an hour wait - so, I did pay the ticket for him online. I do feel bad for Officer Martin, if indeed, he is as lenient with citations as he claims. However, one needs to give the break to the “average joe”, NEVER to someone in power and this example of your mayor Ms. Frankel is the exact reason. All it does is make every “average joe” shake their head and realize the little guy never gets the break and the government is out for themselves, not the people. As I have always told my son, “Do the right thing.”

    As Mayor, doesn’t she know the school zones? Of course she should be ticketed like any other citizen who does not obey the school zone area. I know I would be fined if this happened to me.

    Perhaps it was only the communication of money that was needed to get out of a $411 ticket.

    OFFICER JOSH MARTIN personnel file should be reviewed immediately for any other improper incidents of “discretion” WHAT A HOG WASH. WE DEMAND THAT HE BE FIRED FROM HIS POSITION AS A “POLICE OFFICER” IMMEDIATELY.

    I was stopped on the same area as the mayor and was 5 miles over the speed limit in a school zone and received a 300 dollar ticket without any warning, what is wrong with picture????

    Martin is a disgrace.26 miles over in a schoolzone is worse than going 100mph down So. Dixie. Evidently he had his “QUOTA” or Enforcement Index as they call it.Most motormen wouldn,t think twice if the person doing 26 in a school zone was driving a Chevy or a piece of junk.They have no sympathy for poor people. he said he had to go to another call,where did he think the patrolman was going code 3.he wasn,t needed immediately and had it been anybody but the Mayor they would have been written.Motormen are a strange breed to bad they aren,t policemen.Send them to a disturbance call and they cringe.

    100% OF THE GUILT BELONGS TO THE POLICE OFFICER! THE PROBLEM IS NOT WEATHER SHE BROKE THE LAW,IT’S THE CORRUPT POLICE OFFICER WHO DID NOT DO HIS JOB.     Once again, Queen Lois escapes unscathed. Remember the tow grand jury investigations into the City’s “pay to play” climate? Nothing has changed. Anyone who thinks changing the City charter just to allow her to rule any longer needs a brain scan. Let the term limits do as designed and rid of us this crass, obnoxious politican. In fact, professional politicians as a rule need to find real jobs across the board. Vote out all incumbents! Save our City and country..
